This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with C.T.(Spl.) NDPS Case No. 5 of 2022 corresponding to Dhenkanal Town P.S. Case No. 345 of 2022, pending on the file of the learned Court of the Judge Special Court, Dhenkanal for commission of the offence under Sec. 21(b) of the NDPS Act.

On perusal of the rejection order, it is seen that the allegation is possession of 15 grams 200 Miligram of brown sugar.

It is submitted by the learned counsel for the petitioner that the petitioner is a victim of circumstances and no seizure having been made. His further continuance in custody is punitive and it is submitted that he is in custody since 10.06.2022, his bail application be liberally.

Learned court in seisin over the matter has specifically noted that investigation in the case is in progress. 5.

This is Court is not inclined to entertain this bail application at this stage.

Accordingly, the BLAPL stands rejected.
