Heard learned counsel appearing for the petitioner. Order No.

In course of submission, learned counsel appearing for the petitioner prays for withdrawal of the writ petition with liberty to the petitioner to avail appeal remedy involving the order at pages-15 and 16 to the writ petition. This Court finds there has been bonafide moving to this Court and petitioner undisputedly has the statutory remedy of appeal. Keeping in view the request for withdrawal of the writ petition with liberty to file appeal, this Court permits withdrawal of the writ petition however with liberty as prayed for. 3.
Let the statutory appeal be preferred within a period of two weeks hence along with an application for condonation of delay as well as stay of the impugned order. Petitioner, if is in possession of the disputed property as of now, he will be protected for a period of four weeks within which time the I.A. at the instance of the petitioner shall be considered and disposed of.

The writ petition stands disposed of with the observation and direction made hereinabove.
