This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with Bamapada Industrial Area P.S. Case No. 136 of 2021 corresponding to C.T. Case No. 672 of 2021, pending on the file of the learned SDJM, Balasore, for commission of the alleged offence under Sections 302/120-B/216/34 of the I.P.C. & Sections 25/27 of the Arms Act.

Considering the statements of Ajaya Behera and Umakanta, and on the submission of the learned counsel for the petitioner that this Court examined the role played by Durjay Kumar Das in BLAPL No. 9926 of 2021, Mana @ Manas Kumar Pradhan in BLAPL No. 8836 of 2021, Bhanjay Kumar Behera @ Bhanju in BLAPL No. 8837 of 2021 and Buli @ Gopinath Pakal

in BLAPL No. 8950 of 2021. Ex facie this Court is not persuaded to hold that the petitioner is similarly circumstanced. 4.

Hence, this Court is not inclined to entertain this bail application at this stage.

Accordingly, the BLAPL stands rejected.

6.

It shall be open to the petitioner to move the Court after examination of some of the eye witnesses.
