Heard Mr. D.K. Sahoo, learned counsel for the petitioner and Mr. D. Nayak, learned Additional Government Advocate. On oral prayer, Mr. Sahoo is permitted to implead the Principal Secretary to Govt. of Odisha in the Department of Food Supplies and Consumer Welfare as opposite party No.5 in the cause title in Court today.

According to Mr. Sahoo, the petitioner belongs to village Banamali in the district of Ganjam, which comes under BLN Pur Grama Panchayat under Digapahandi Block. For the purpose of getting his ration, the petitioner has to depend upon the Retail Fair Price Shop which is situated at a distance of 11 K.M. from his village. As a result of which, the petitioner and other villagers are facing lots of difficulties. In such background, he submits that the opposite parties be directed to open a Retail Shop in the village of the petitioner.

Mr. D. Nayak submits that for redressal of such grievances, the petitioner should have approached the Principal

// 2 // Secretary, Food Supplies & Consumer Welfare Department, Govt. of Odisha (opposite party No.5) instead of rushing to this Court.

In such background, Mr. Sahoo submits that liberty may be granted to the petitioner to approach the opposite party No.5 for redressal of his grievances by filing a grievance petition and prays that the said opposite party be directed to take a decision on such grievance petition within a specific time period. 5.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a grievance petition before opposite party No.5 through registered post within a period of two weeks from today. In the event, such a petition is filed along with a copy of this order, the opposite party No.5 is directed to take a decision on the same in accordance with law within a period of eight weeks from the date of receipt of such grievance petition and communicate the result of such exercise to the petitioner.

Accordingly, this writ petition is disposed of. 7.

Urgent certified copy of this order be granted on proper application.
