Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioner is an accused in connection with Spl. G.R. Case No. 77 of 2022 arising out of Kanpur P.S. Case No. 79 of 2022, pending on the file of the learned Addl. Sessions Judgecum-Special Court under POCSO Act, Cuttack for the alleged commission of offence under Sections-363/366/376(2)(n) of the I.P.C. read with Section-6 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge-cumSpecial Court under POCSO Act, Cuttack by Order dtd. 29.06.2022 in Spl. G.R. Case No. 77 of 2022, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim, noting the tenor of the same and taking into account the period of custody, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter, 6.
The Bail Application thus stands disposed of. 7.
