This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.34 of 2022, pending in the file of learned J.M.F.C., R. Udayagiri, arising out of Mohana P.S. Case No.28 of 2022, offence under Sections 363/341/323/294/307/506/34 of IPC and is in custody since 05.05.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Assistant Sessions Judge, R.Udayagiri by order dated 24.06.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the instructions of the learned counsel for the State regarding the health condition of the victim, which is on record, this Court is not inclined to entertain this bail application at this stage.

It shall be open to the petitioner to move the learned Court in seisin over the matter at a later stage, if so, advised. 7.

Accordingly, the BLAPL stands disposed of.

8.

Urgent certified copy of this order be granted as per the rules.
