This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

None appears for the petitioner at the time of call. The petitioner by way of an application U/S. 482 of Cr.P.C. has sought for to quash the FIR under Bargarh P.S. Case No.236 of 2014 corresponding to C.T. Case No.631 of 2014 of the Court of learned S.D.J.M., Bargarh and the corresponding criminal proceeding, but no stay has been granted by this Court from proceeding further in the criminal case and in the meanwhile, already seven years have elapsed. Therefore, this Court reasonably entertains a doubt as to whether the cause of action still survives for the petitioner or not.

In view of the above facts, it seems that the petitioner is not interested to prosecute the matter.

Hence, the CRLMC is dismissed for non-prosecution. ( G. Satapathy) Judge Subhasmita
