Through this writ petition the Petitioner taking support of the Order No.

disclosures in Annexure-1 more particularly at item no.5 therein, alleges that when the proposal is made for construction of a C.C. Road from Manjuripur NH 16 to Niranjan Das house, an attempt is made to construct such road over the Gochara land. Learned counsel for the Petitioner alleges that construction of such road is not being made in terms of the proposal under Annexure-1. It is brought to the notice of this Court through Annexure-3 that in the meantime the Villagers have already made a complaint in this regard to the B.D.O, Simulia pending since June, 2022.

Finding the above allegation of the Petitioner to be a serious one, this Court directs the B.D.O, Simulia to consider the request of the Villagers and take appropriate steps on the complaint of the Petitioner, if necessary, entering into appropriate inquiry. Order, as appropriate, in this matter be passed within a period of fifteen days from the date of communication of a certified copy of this order by the Petitioner.

It is further directed that if there is no substantial progress involving the construction in question, there shall be status quo in respect of such construction over the disputed land in question for a period of fifteen days.
