This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

It is submitted by the learned counsel for the State that notice has been served on the informant/victim on 07.08.2022. There is no appearance on behalf of the informant/victim when the matter is called.

The petitioner is an accused in C.T. Case No.26 of 2022, pending on the file of the learned Special Judge under POCSO Act, Mayurbhanj, arising out of Baripada Town P.S. Case No.156 of 2022, offences under Sections 376(3)/376(2)(n)/500/506/384/34 of IPC and U/s. 6/14/15 of POCSO Act and U/s.67 of I.T. Act. 5.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Presiding Officer Spl. Court under POCSO Act, Mayurbhanj, Baripada, by order dated 13.06.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations made by the victim against the petitioner who is her teacher, this Court is not inclined to entertain this bail application at this stage. 7.

It shall be open for the petitioner to renew his prayer after the examination of the victim.

Accordingly, the BLAPL stands disposed of.
