The present Contempt Petition has been filed for the alleged willful disobedience of the order dated 23rd February, 2022 passed by this Court in W.P (C) PIL No.2025 of 2022 directing the Collector, Kendrapara to examine the representation filed by the petitioners in respect of removal of encroachments by the Nine impleaded private-opposite parties.

It is submitted that no action has been taken by the Collector, Kendrapara.

At the time of hearing, Mr. Samantaray has produced a copy of the official letter dated 19th August, 2022 issued by the Tahasildar, Derabish and addressed to the Collector, Kendrapara, wherein it is submitted that on conduct of a survey of the filed area, it has been found that only three individuals to

// 2 // be in unauthorized possession i.e. (1) Damodar Mohanty, S/o-Golakha Mohanty, (2) Labani Sahoo, who is the mother of one Rajendra Sahoo (impleaded as Opposite Party No.12 in the Writ Petition) and (3) Gagan Bihari Mohanty, S/o- Damodar Mohanty. The said letter also reflects that the action against the three encroachers has been initiated.

Copy of the said letter has been furnished to Mr. Pattnaik, learned counsel appearing for the petitioners and also retained on record.

In view of the above, the present Contempt Petition stands dismissed as infructuous.
