Heard learned counsel for the Parties.

Considering the submissions of the respective counsel and the order dated 12.7.2022 passed by this Court, the case is taken up for fresh disposal.

The second prayer of the Petitioner is dismissed for not being maintainable through the Writ Petition. Petitioner, if so advised, may undertake such exercise under appropriate proceeding. Coming back to the first prayer involved seeking response from the Development Authority as to why there is no grant of permission within the time directed by this Court in disposal of W.P.(C) No.22177 of 2017. There is no dispute at Bar that even including the
// 2 // learned counsel for the Petitioner that following the direction in the said Writ Petition, there has been already grant of third party permission.

It is at this stage of the matter, learned counsel for the Petitioner raises some disputes involving transaction pursuant to the third party permission being granted here. Any further dispute involving transaction and shortfall, if any, between the Parties cannot be maintainable in a Writ Petition. It is open to the Parties, if so advised, may undertake appropriate exercise. 5.
