Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with 2(a) C.C. Case No. 126 of 2022 arising out of P.R. No. 51 of 2022-23, pending on the file of the learned S.D.J.M., Athagarh for the alleged commission of offence under Section-52(a) (i) of Excise Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judge, Athagarh by Order dtd. 30.06.2022 in BLAPL No.211 of 2022, the present BLAPL has been filed.

Taking into account the nature of allegations, the period of custody and the punishment prescribed, this Court directs the petitioners to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter. ` 6.

The Bail Application thus stands disposed of. 7.
