Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Special (NDPS) Case No. 07 of 2022 arising out of Kaniha P.S. Case No. 165 of 2022, pending on the file of the learned Addl. Special Judge, Talcher for the alleged commission of offence under Section-20(b)(ii)(B) of the N.D.P.S. Act. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Special Judge, Talcher by Order dtd. 28.06.2022 in C.T. Special (NDPS) Case No. 07 of 2022, the present BLAPL has been filed.

Learned counsel for the petitioner places on record, the seizure memo in respect of both the petitioners, which indicate that no seizure of contraband (Ganja) have been effected. 6.

The seizure memo filed by the petitioner is kept on record.

Taking note of the same and keeping in view the period of custody, this Court directs the petitioners to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter.
