Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioner is an accused in connection with C.T. Special (NDPS) Case No. 07 of 2022 arising out of Kaniha P.S. 165 of 2022, pending on the file of the learned Addl. Special Judge, Talcher for the alleged commission of offence under Section- 20(b)(ii)(B) of the N.D.P.S. Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Special Judge, Talcher by Order dtd. 28.06.2022 in C.T. Special (NDPS) Case No. 07 of 2022, the present BLAPL has been filed.

Taking note of submission that, the role ascribed to the petitioner and keeping in view the quantity of contraband (Ganja)

seized being to the tune of 4 Kgs 600 grams less than commercial quantity, the period of custody as submitted by the learned counsel for the petitioner, this Court directs the petitioner to be released on bail, on such terms and conditions to be fixed by the learned Court in seisin over the matter 6.

The Bail Application thus stands disposed of. 7.
