This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Alleging violation of the order dated 24.10.2019 this CONTC has been filed. In paragraph-5 of show cause the reason for non-implementation of the order passed by this Court has been indicated which is quoted hereunder for convenience for ready reference:

"That, in obedience to the aforesaid order of Hon'ble Court, the Opposite Party No.2, Collector, Keonjhar of the said writ petition felt that there is legal impediment in publishing the result of skill test held on

03.02.2014 on the ground that 26 candidates who were declared disqualified and 05 candidates who were absent in 1st Computer Skill Test making a total of 31 candidates were given chance to attend the computer skill test for the 2nd time which contradicts the terms and conditions laid down in the advertisement for the recruitment of 106 Junior Clerks issued vide office Letter No.XLI-59/13-2145/BBE/ Dt.07.07.2013.

Copy of the Letter No.XLI-59/132145/BBE/dtd.07.07.2013 is annexed herewith as Annexure-A."

This Court does not appreciate the manner and the tenor in which the show cause has been drafted. But, considering the reasons stated in the show cause, comes to the finding that there has been no willful violation of the order passed. The contempt proceeding is dropped.

It is open for the petitioner to approach this Court by filing a fresh writ petition if the cause of action so warrants and if so advised.

Accordingly, the CONTC stands disposed of.
