Heard Mr. S.K. Das, learned counsel for the petitioner and Mr. D.K. Mohanty, learned Additional Standing Counsel. 2.

Mr. Das, learned counsel for the petitioner submits that after pronouncement of award in favour of the petitioner in I.D. Case No. 11 of 2012 on 18th December, 2021 granting a compensation to the tune of Rs.2,00,000/- to the petitioner in lieu of reinstatement in service, the same has not been complied by the Management.

In such backgrounds, she filed an application on 12.01.2022 in Form T-1 of the Orissa Industrical Disputes Rule, 1959 before the Secretary to the Government of Odisha, Labour and ESI Department, Bhubaneswar (opposite party no.1) under Sub Section 1 of Section 33-C of the Industrial Disputes Act, 1947 for recovery of the money due vis-à-vis the award as indicated above. However, he submits that till date no decision has been taken on her application in Form

// 2 // T-1 under Annexure-7. Accordingly, he prays that a direction be issued to the opposite party no.1 to take a decision on the above noted application within a specific time period. 4.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Secretary to the Government of Odisha, Labour and ESI Department, Bhubaneswar (opposite party no.1) to take a decision on the above noted application in accordance with law within a period of three weeks, if there is no other impediment and communicate the result of such exercise to the petitioner.

The writ petition is accordingly disposed of. 6.

Urgent certified copy of the order be granted on proper application.
