Heard learned counsel for the petitioner and Mr.Mohapatra, learned counsel for the State.

In fact, by this Court's order dated 13th July, 2022 in CRLMC No. 1844 of 2022, the petitioner was directed to surrender and move regular bail within four weeks time and he shall be allowed to go on bail on such terms and conditions.

Learned counsel for the petitioner submits that due to a communication lapse, the above order of this Court, could not be intimated to the petitioner, consequent upon which, he failed to turn up and surrender before the learned court below and therefore, time of surrender should be extended for complying the said direction in CRLMC No. 1844 of 2022. An objection is received from Mr. Mohapatra, learned counsel for the State.

For the reason stated and considering the fact that the petitioner has been granted the liberty to surrender before the court in seisin over the matter but failed to do so, the Court is of the opinion that an opportunity should be provided to surrender within the extended period and accordingly, it is directed. 5.

I.A. stands disposed of with a direction to the petitioner to surrender before the Court of learned SDJM, Bolangir in connection with G.R. Case No.873 of 2007 corresponding to Bolangir Sadar P.S. Case No. 322 of 2007 on or before 2nd December, 2022 in compliance of the Court's order in CRLMC No.1844 of 2022. 6.
