This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.198 of 2022, pending in the file of learned J.M.F.C. Bhuban, arising out of Bhuban P.S. Case No.210 of 2022 under Sections 294/323/307/506/498(a)/34 of IPC and is in custody since 25.05.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Kamakhyanagar by order dated 30.06.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that there was no premeditation and out of fit of anger the offence was committed. 6.

Learned counsel for the State opposes the prayer for bail.

Taking into account that the petitioner is the husband and there is substantial progress in investigation and considering the injury report, this Court directs petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
