This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.1881 of 2022 pending in the file of learned S.D.J.M., Sambalpur, arising out of Khetrajpur P.S. Case No.145 of 2022, offence under Sections 147/148/452/324/307/149 of IPC and is in custody since 14.05.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sambalpur by order dated 30.06.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that co-accused similarly circumstanced was released on bail by this Court by order dated 27.07.2022 in BLAPL No.5238 of 2022 on the consideration
that the injuries suffered are simple in nature. Hence on the ground of parity the petitioner seeks bail.

Taking into account the release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 7.
Additionally, it is directed that the petitioner shall appear before the jurisdictional police station once in every week till the submission of the final form.

Accordingly, the BLAPL stands disposed of.
