Heard learned counsel for the Parties.

Considering that the Petitioner has a statutory remedy of appeal, this Court permits the Petitioner to withdraw the Writ Petition with liberty to file appeal involving the impugned order. Petitioner may file memorandum appeal along with application for condonation of delay as well as application for interim protection at least within a period of two weeks hence. In such event, the delay in filing appeal shall be condoned and the appeal shall be heard and disposes of on its own merit within a reasonable time. The application for interim protection shall also be considered and disposed of at least within a period of four weeks from the date of its filing. 3.

This Court further directs in the event the Petitioner has not been evicted from the disputed land as yet, status quo as on today in respect of the disputed property shall be maintained by all concerned at least for a period of five weeks.
