This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are accused in G.R. Case No.34 of 2022 pending in the file of learned Civil Judge (Junior Divisioon)-cumJ.M.F.C., Lamtaput, arising out of Machhkund P.S. Case No.47 of 2022, offence under Sections 147/ 148/ 294/ 323/ 307/ 353/ 395/ 506/332/341/342/149 IPC and Sections 25/27 of the Arms Act and are in custody since 16.05.2022.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Koraput by order dated 24.06.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioners that taking into account the generality of the allegations and the

injury being categorized as simple, further custody of the Petitioners is not warranted. It is further submitted that the Petitioners are the first offender.

Learned counsel for the State opposes the prayer for bail, inter alia, on the ground that the Petitioners have been identified in the T.I parade.

Taking into account the genesis of the case and the period of custody, this Court directs the Petitioners to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
