This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner accused in G.R. Case No.2679 of 2021, on the files of learned J.M.F.C.(R), Cuttack, arising out of Jagatpur P.S. Case No.468 of 2021, under Sections 379/413/201/114 of IPC is in custody since 21.04.2022.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned First Additional Sessions Judge, Cuttack by order dated 21.06.2022 in the aforementioned case, the present BLAPL has been filed.

Petitioner relies on the order passed by this Court dated 28.06.2022 in BLAPL No.5427 of 2022 by which the co-accused

was released. Hence, it is prayed inter alia on the ground of parity that the petitioner seeks release on bail.

Taking into account the nature of allegation and release of the co-accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioners shall appear before the jurisdictional Police Station once every week till the conclusion of trial.

Violation of condition of such appearance shall entail cancellation of bail by the learned Court in seisin over the matter after following the due process of law without any further reference of this Court.

Accordingly, the BLAPL stands disposed of.
