This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Deogarh P.S. Case No.202 of 2022 corresponding to Spl. G.R. Case No.12 of 2022, pending in the Court of learned Sessions Judge, Deogarh under Section 20(b)(ii)C of NDPS Act.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Deogarh, by order dated 21.03.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the rejection order.

It is submitted by learned counsel for the petitioner that coaccused is similarly circumstanced has already been released on bail by order dated 29.06.2022 in BLAPL No.3147 of 2022.

Taking note the release of the co-accused and since the petitioner is prima facie similarly circumstanced, this Court directs the petitioner to be released on bail on terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
