Heard learned counsel for the Parties.

Taking this Court to the relief sought for, a claim is made by the learned counsel for the Petitioner that involving the selfsame advertisement and similar nature of penal order, a batch of Original Applications came before the Tribunal, vide O.A.Nos.3630(C)/2007, 2630(C)/2007, 2631(C)/2007, 2634(C)/2007, 4(C)/2008, 5(C)/2008 & 2682(C)/2007 and disposed of by its order dated 9.12.2011 favouring the similarly situated person. A request is thus made for granting same relief here as there is no possibility of a different view. There is no submission as to if such order attended finality.

Considering such submission, this Court directs learned counsel for the Petitioner to give a certificate that the cases involved therein arise out of same cause of action, further also to certify by way of affidavit of the Petitioner that the order involved therein not being challenged any further or affected on the interference within a period of three weeks.

Learned counsel for the Petitioner is directed to serve a copy of the order dated 9.12.20211 of the Tribunal passed in O.A. No.3630(C)/2007 on the learned Additional Government Advocate, who is also to find out if the order claimed to be applied here has not been challenged and not altered by any higher forum. 5.

The Writ Petition stands disposed of accordingly. 6.

A free copy of this order be supplied to Mr.Panda, learned Additional Government Advocate.
