This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The Petitioners are accused in connection with G.R. Case No. 233 of 2022 arising out of Parlakhemundi P.S. Case No. 88 of 2022 pending on the file of learned S.D.J.M., Parlakhemundi registered for the alleged commission of offence under Sections294/435/379/506/34 of the I.P.C. read with Section-4 of Public Property (Prevention of damage) Act, 1985.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Additional Sessions Judgecum-Special Judge, Paralakhemundi, Gajapati by order dated

04.07.2022 in B.A. No. 37 of 2022, the present BLAPL has been filed.

Taking into account the nature of the accusation and the punishment prescribed, though the petitioners have antecedents as stated by the learned counsel for the State, this Court directs the petitioners to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter, additionally it is directed that the petitioners shall appear before the local Police Station once every week till the conclusion of the trial and their certification shall be submitted before the Court in Seisin over the matter.

The first date and time of such appearance to be fixed by the learned Court below.

It is needless to say, violation of any conditions shall entail cancellation of this Order.

Accordingly, the BLAPL stands disposed of.

9.

Urgent certified copy of this order be granted as per rules.
