Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 08.04.2021 in connection with Bhubaneswar STF P.S. Case No. 12 of 2019 corresponding to T.R. Case No. 335 of 2019 pending in the court of learned 3rd Additional Sessions Judge, Bhubaneswar for the alleged commission of offence under Sections 21(b) of NDPS Act read with Sections 25/27 of Arms Act.

It is alleged that the petitioner was in possession of contraband brown sugar weighing 130 grams when he was apprehended by police. It is submitted that the petitioner was implicated only on the basis of the statement of the co-accused and nothing was seized from his exclusive possession. Even otherwise, the co-accused persons have been released on bail as per orders passed by this

Court in BLAPL No.9807 of 2021, BLAPL No 2881 of 2020 and BLAPL No. 7312 of 2019.

Considering the above facts as also the fact that the seized contraband is less than commercial quantity, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.
