This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The Petitioner is an accused in connection with 2(a) C.C. Case No. 136 of 2022 arising out of E.I. & E.B. Unit-II (N.D.), Sambalpur P.R. No. 170 of 2022-23 pending on the file of learned S.D.J.M., Kuchinda registered for the alleged commission of offence under Sections-52(a)(i)(c)/52(b)/62 of Odisha Excise Act. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Additional District & Sessions Judge, Kuchinda by order dated 29.06.2022 in BLAPL No.29 of 2022, the present BLAPL has been filed.

Taking into account the nature of allegation and the punishment prescribed, this directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter, additionally it is directed that the petitioner shall appear before the concerned Excise Officials once every week till the submission of the final P.R. 6.

Accordingly, the BLAPL stands disposed of.
