Heard learned counsel for the petitioner and learned counsel for the State.

The Petitioner is an accused in connection with 2(a) C.C. Case No. 06 of 2022 arising out of P.R. Case No. 12 of 2022-23 pending on the file of learned Sessions Judge-cum-Special Judge, Parlakhemundi registered for the alleged commission of offence under Sections-20(b)(ii)(B) of the N.D.P.S., Act. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Paralakhemundi, Gajapati by order dated 01.06.2022 in 2(a) C.C. Case No. 06 of 2022, the present BLAPL has been filed.

Taking into account the quantity of contraband (Ganja) seized being 11.100 Kgs., which is admittedly less than the commercial quantity, considering the period in custody, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter, with the additional stipulation that the petitioner shall appear before the jurisdictional Police Station once every week till submission of the Final Form.

The first date and time to such appearance to be fixed by the learned Court below.

Accordingly, the BLAPL stands disposed of.
