Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in connection with C.T. Case No. 144/41 of 2022(POCSO) arising out of Junagarh P.S. Case No. 147 of 2022, pending on the file of the learned Addl. District Judge-cum-Special Court under POCSO Act, Bhawanipatna for the alleged commission of offence under Sections-366/363/376 (2)(n) of the IPC read with Section-6 of the POCSO Act. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned A.D.J.-cum-Spl. Court under

POCSO Act, Bhawanipatna by Order dtd. 04.07.2022 in C.T. No. 144/41 of 2022, the present BLAPL has been filed. 5.

The 164 Cr.P.C. statement filed by the petitioner is taken on record.

Considering the tenor thereof and taking into account the period in custody and being cognizant of the fact that the Chargesheet has already been filed in the meanwhile, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The Bail Application thus stands disposed of. 8.
