This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offences punishable under Sections 294-A/420/120-B/34, I.P.C. and Sections 4 & 5 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978. 4.

It is submitted by learned counsel for the Petitioner that the entire amount of Rs.4,56,900/- has already been recovered by the Police. He further submits that the allegation, so far as the present Petitioner is concerned, is that the Petitioner was asking to play IPL Cricket betting.

However, considering the fact that the entire amount has already been recovered by Police and also the present Petitioner is

// 2 // stated to have no other similar nature of criminal antecedent, although I am not inclined to grant anticipatory bail to the Petitioner, however it is observed that, in the event the Petitioner surrenders before the learned S.D.J.M., Berhampur in G.R. Case No.991 of 2022 corresponding to Gosaninuagaon P.S. Case No.78 of 2022 within a period of three weeks from today, the Petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper in the facts and circumstances of the case, subject to further conditions that the Petitioner shall not involve in similar nature of activities in future while on bail and if it is found that the Petitioner is again involved in similar nature of offence, then the order of bail shall stand revoked. 6.

The ABLAPL is disposed of accordingly.
