This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioners are accused in connection with T.R. Case No. 66 of 2022 corresponding to (Spl. G.R.Case No. 80 of 2021) arising out of Nuagaon P.S. 74 of 2021, pending on the file of the learned Sessions Judge-cum-Spl. Judge, Nayagarh for the alleged commission of offence under Section- 20(b)(ii)(B) of the N.D.P.S. Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge-cum-Spl. Judge, Nayagarh by Order dtd. 31.08.2022 in T.R. No. 66 of 2022, the present BLAPL has been filed.

Considering the submission of the learned counsel for the petitioner that the charge-sheet has already been submitted in the meanwhile and Taking into account that the quantity of contraband (Ganja) involved i.e., 10 Kgs 100 grams and the period in custody, this Court directs the petitioner to be released on bail, on such terms and conditions to be fixed by the learned Court in seisin over the matter.

The Bail Application thus stands disposed of. 7.
