Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioner is an accused in connection with C.T. Case No. 1398 of 2022 arising out of Jharsuguda P.S. Case No. 293 of 2022 pending on the file of the learned S.D.J.M., Jharsuguda for the alleged commission of offence under Sections379/411/120(B)/34 of the I.P.C. read with Sections 21 of the Mines & Minerals (Development & Regulation Act /18(1) of the Orissa Minerals (Prevention of theft, Smuggling & Illegal Mining and Regulation of Possession, Storage, Trading and Transportation ) Rules.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge,

Jharsuguda by Order dtd. 28.06.2022 in Bail Application No. 232 of 2022, the present BLAPL has been filed.

Taking into account that the release of the co-accused by Order dtd. 13.07.2022 and keeping in view the nature of the allegation and punishment prescribed, this Court directs the petitioner to be released on bail, on such terms and conditions to be fixed by the learned Court in seisin over the matter. 6.

The Bail Application thus stands disposed of. 7.
