Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in connection with C.T. Case No. 399 of 2022 arising out of Baisinga P.S. Case No. 143 of 2022, pending on the file of the learned J.M.F.C., Betnoti for the alleged commission of offence under Sections-376(2)(n) of the IPC.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned 2nd Addl. Sessions Judge, Baripada by Order dtd. 28.06.2022 in BLAPL No. 331 of 2022, the present BLAPL has been filed.

Perused the 164 Cr.P.C statement and the Medical Examination Report of the victim, as extracted in the Case Diary. Considering the tenor of the same along with 164 Cr.P.C. statement and period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The Bail Application thus stands disposed of. 7.
