This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Cyber Crime P.S. Case No.6 of 2022 corresponding to G.R. Case No.537 of 2022, pending in the Court of learned J.M.F.C.(City), Cuttack under Sections 419/420/467/468/471/120-B/34 of IPC and Sections 66(C) and 66(D) of Information Technology Act, 2000.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Vigilance, Cuttack, by order dated 05.07.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Perused the rejection order.

It is submitted that named accused person whose complicity is greater keeping in view the allegation as leveled has been released on bail by this Court by order dated 13.07.2022 in BLAPL No.5773 of 2022. Hence on the ground of parity learned

counsel for petitioner Mr. R.Ch. Behera seeks release. It is also submitted that two other accused persons similarly placed have since been released on bail.

Taking into account the release of the co-accused who are prima facie similarly circumstanced, this Court directs the petitioner to be released on bail on terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
