This matter is taken up through hybrid mode.

This CMP has been filed assailing the order dated 31st March, 2022 passed by learned Senior Civil Judge, Jharsuguda in C.M.A. No.16 of 2017, whereby an application under Order IX Rule 7 C.P.C. was dismissed for non-prosecution. 3.

In course of hearing, Mr. Routray, learned counsel for the Petitioners submits that interest of justice will be best served, if the Petitioners file an application for restoration of the said CMA. He, therefore, prays for withdrawal of the CMP to enable the Petitioners to move such an application.

In view of such submission, this CMP is disposed of as withdrawn.

Urgent certified copy of this order be granted on proper application.
