This matter is taken up through hybrid mode.

This CMP has been filed assailing the order dated 11th April, 2022 (Annexure-2) passed in I.A. No.460 of 2020 (arising out of C.S. No.431 of 2020), whereby an application under Order XXXIX Rules 1 and 2 filed by the present Petitioner was rejected.

Mr. Mohapatra, who appears in person as well as on behalf of Petitioner No.2 prays for withdrawal of the CMP stating that the order impugned herein is appealable. 4.

Accordingly, the CMP is disposed of as withdrawn. 5.

Certified copy of the impugned order under Annexure2 shall be returned to the Petitioner on substitution of attested photocopy thereof.
