Heard learned counsel for the Parties.

The Writ Petition involves a challenge to the order of suspension on the premises that there is no payment of subsistence allowance. The Original Application was filed in 2006. The suspension order cannot be remained in operation for such long time. While disposing of the Writ Petition, this Court observes, in the event the disciplinary proceeding is already over involving outcome, the Petitioner, if so advised, may file a fresh application. Considering the further dispute involved herein that there has been no payment of subsistence allowance for some period, this Court observes, in the event involving the suspension period, there has been no payment of subsistence allowance, same may be worked out by completing the entire exercise within a period of two months from the date of communication of this order by the Petitioner.
