This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offences punishable under Sections 363/366/376(2)(n)/109, I.P.C. and Section 4 of the POCSO Act.

Learned counsel for the Petitioner submits that the coaccused Gila Das has already been released on bail by the learned Sessions Judge, Kendrapara in G.R. Case No.45 of 2022 vide order dated 20th June, 2022.

In view of such fact, and considering the nature of allegation, gravity of the offence and the facts of the case, although I am not inclined to grant anticipatory bail to the Petitioner, however it is

// 2 // observed that, in the event the Petitioner surrenders before the learned Addl. Sessions Judge-cum-Special Judge, Kendrapara within a period of three weeks from today, the Petitioner shall be released on bail on such terms and conditions as the learned Sessions Judgecum-Special Judge may deem just and proper in the facts and circumstances of the case.

The ABLAPL is disposed of accordingly.
