Mr. A.K.Nayak, learned counsel has filed the Vakalatnama. Registry is requested to trace out the same and tag with the file.

Heard learned counsel for the parties.

The petitioner is an accused in connection with G.R. Case No. 219 of 2022 arising out of Nayagarh P.S. Case No. 43 of 2022, pending on the file of the learned SDJM, Nayagarh, for the alleged commission of offence under Sections 147/ 148/ 302/ 307/ 337/338/323/325/149 of the I.P.C.

Being aggrieved by the rejection of his application for bail under Sec. 439 Cr.P.C. by the learned Addl. Sessions Judge, Nayagarh, by order dated 27.06.2022, the present BLAPL has been filed.

The consideration by the learned Court in seisin over the matter was during the course of investigation. 7.

The petitioner is at liberty to move the learned Court below after filing of Charge-Sheet. The same shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

The Bail Application thus, stands disposed of. 9.

Urgent certified copy of this order be granted as per rules.
