This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in Banarpal P.S. Case No.197 of 2022 corresponding to G.R. Case No.578 of 2022, pending in the Court of the learned J.M.F.C., Banarpal, Angul, for alleged commission of offences under 341/324/307/34 of IPC. 4.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Angul, by order dated 04.07.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the State has placed on record the copy of the charge-sheet.

On perusal of the same it is seen that the petitioner is mentally challenged.

Taking note of the same and the background in which the offence is stated to have been committed, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. Copy of the final form is taken on record.

Accordingly, the BLAPL stands disposed of.
