Heard learned counsel for the Petitioner.

The Petitioner in this writ Petition sought for quashing of the order dated 29.03.2019, passed by the Asst. Sessions Judge (STC), Jajpur in C.T. No.311 of 2013 arising out of Jenapur P.S. Case No.118 of 2011, wherein N.B.W. has been issued against the Petitioner.

It is stated that in the aforesaid case, Petitioner has been acquitted and he is now ready and willing to cooperate in the trial. Accordingly, he prays that he may be released on bail on surrendering before the court below.

Considering the facts and submission, it is directed that in the event Petitioner surrenders before the court in seisin of the matter within four weeks hence and supply an advance copy of this order to the court below to prepare the accused statement, the court concerned after recording of his statement
// 2 // shall allow him to release on bail on such terms and conditions as deem fit and proper including the condition that Petitioner shall cooperate with the trial. Till then, the execution of the NBW against the Petitioner shall not be executed. 6.
CRLMC is accordingly disposed of.
