This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The Petitioner is an accused in connection with P.R. No. 72 of 2022-23 No. 527 of 2022 corresponding to Spl. 2(a) CC Case No. 13 of 2022 pending on the file of learned Special Judgecum-Sessions Judge, Nayagarh registered for the alleged commission of offence under Sections 18(c) of the NDPS Act. 4.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the I/C Sessions Judge-cum-Spl. Judge, Nayagarh, by order dated 4.07.2022, the present BLAPL has been filed. The petitioner is stated to be in custody since 22.06.2022. 5.

Taking in account the seizure of contraband being to the tune of 0.490gms of Opium which is admittedly less than the commercial quantity and the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the local Police Station once every seven days till conclusion of the investigation.

Accordingly, the BLAPL stands disposed of.
