Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R.Case No. 203 of 2022 arising out of Subalaya P.S. Case No. 55 of 2022 pending on the file of learned SDJM, Birmahrajpur, registered for the alleged commission of offence under Sections 376(1) and 506 of the I.P.C.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the learned Sessions Judge, Sonepur, by order dated 21.06.2022, the present BLAPL has been filed. The petitioner is stated to be in custody since 4.05.2022. 5.

Taking into account the materials on record, 164 Cr.P.C. statement of the victim and the factum of the victim denying for medical examination and keeping in view the period of custody,

this Court directs the petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 6.

Accordingly, the BLAPL stands disposed of.
