1. This matter is taken up through hybrid arrangement.

2. Heard.

3. In this Writ Petition, the petitioner seeks to quash the order of appointment/promotion to the post of A.C.T.O. in so far as it relates to Respondent Nos. 3 and 4. He further seeks a direction from this court to the Respondent No.2/Commissioner Commercial Taxes, Cuttack to appoint/promote him to the post of A.C.T.O. from the date of Respondents promoted to the post of A.C.T.O. and recast his seniority above the Respondent No.3 & 4.

4. Learned counsel for the petitioner submits that this matter is become infructuous.
