This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.254 of 2022, pending in the file of learned JMFC(R), Cuttack, arising out of Jagatpur P.S. Case No.47 of 2022, for alleged commission of offence under Sections 394 of IPC and is in custody since 19.04.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned First Additional Sessions Judge, Cuttack by order dated 30.06.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the criminal proclivity of the petitioner since the trial has already commenced, this Court is not inclined to entertain this bail application at this stage.

Since the petitioner is in custody from 19.04.2022 as submitted, the learned Court in seisin is called upon to conclude the trial within a period of four months from the date of receipt/production of certified copy of this order. 7.
In the event the trial is not concluded within the time stipulated, it shall be open to the petitioner to renew his prayer before the learned Court in seisin over the matter and same shall be considered on its own merits without being influenced by the earlier rejection or the order passed by this Court.

Accordingly, the BLAPL stands disposed of.
