This matter is taken up through Hybrid mode.

This CMP has been filed for early disposal of CS No.351 of 2016 pending before learned Civil Judge (Senior Division), Kendrapara.

Learned counsel for the Petitioner submits that the suit has been filed for specific performance of contract. It is his submission that pleadings of the parties are complete in the suit. Since the suit has been filed in the year 2016 and there is also no legal impediment for early disposal of the suit, hence, a direction to that effect may be issued.

Since the order sheets of the suit has not been filed, this Court is not in a position to appreciate the stage of the suit. However, taking into consideration the innocuous nature of prayer made by learned counsel for the Petitioner, this Court, disposes of the CMP with an observation that in the event Petitioner files an application for early disposal of CS No. 351 of 2016 pending before learned Civil Judge (Senior Division), Kendrapara stating the grounds therein, learned trial Court shall
// 2 // do well to consider the same and proceed with the matter in accordance with law. Parties are directed to cooperate learned trial Court for early disposal of the suit, if there is no legal impediment.
Issue urgent certified copy of the order on proper application.
