Hadibandhu Panigrahi v. Orissa State Pollution Control Board
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.A. No. 145 of 2016 Hadibandhu Panigrahi ....
Appellant Mr. Milan Kanungo, Senior Advocate -versusOrissa State Pollution Control Board and others ....
Respondents Mr. Bibudhendra Dash, Advocate Mr. Debakanta Mohanty, A.G.A. for State
CORAM:
THE CHIEF JUSTICE JUSTICE M.S. RAMAN
ORDER
20.12.2022 Order No.
12.
1. The matter was passed over since a lawyer appeared in the first call without the paper book saying that he has been engaged to appear in the matter. The Court was surprised that the engagement had been accepted without the lawyer even looking at the paper book and accordingly at his request the matter was passed over. After pass over, Mr. Kanungo, Senior Counsel appeared in hybrid mode but without the camera being switched on, which meant that he was audible but not visible to the Court. Unfortunately, the situation was no better with Mr. Kanungo admitting that he too did not have the paper book and was not in a position to argue.
2. In the circumstances, the writ appeal is dismissed for nonprosecution with liberty to the Appellant revive it once the paper books are made available to counsel.
