This matter is taken up through Hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner being in custody in Special G.R. Case No.13 of 2016, arising out of Sonepur P.S. Case No.66 of 2016, pending in the court of the learned Addl. Sessions Judge-cum-Special Judge, Sonepur, has filed this petition for his release on bail. The offence alleged against him is punishable under Section 20(b)(ii)(C) of the N.D.P.S. Act. 4.

During course of hearing, learned counsel for the petitioner submits that he does not want to press this bail application, but a direction may be given to the Court below to expedite the trial of the aforesaid case.

Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for bail stands rejected as not pressed.

However, since it is stated by the learned counsel for the petitioner that in the aforesaid case only the Investigating Officer is yet to be examined, this Court directs the trial Court to take all coercive steps to conclude the trial as expeditiously as possible preferably within a period of three months of receipt / production of the certified copy of this order, if there is no other legal impediment. Both parties shall cooperate for disposal of the case. It is made clear that if the trial is not concluded within the time stipulated, the petitioner may renew his prayer for bail thereafter.

Accordingly, the BLAPL stands disposed of being dismissed.
