Heard learned counsel for the petitioner and learned counsel for the State.

Pursuant to order dated 07.09.2022, learned State Counsel has obtained instructions from the District Education Officer, Nayagarh that the technical defect in online mode has since been sorted out and the pension papers of the petitioner have been sent to the Controller of Accounts, Odisha, Bhubaneswar vide letter no.8990 dated 06.09.2022 after necessary sanction by the PSA for finalization of pensionary benefits. The same has also been received at the end of the Controller of Accounts. Such being the case, nothing further remains to be decided in the present writ petition,

which is therefore, disposed of. It shall be open to the petitioner to submit a representation along with certified copy of the order to the Controller of Accounts to finalize the pension as early as possible. 4.

Taking into account the fact that the submission of pension papers was delayed for reasons beyond the control of the petitioner, if such representation is filed, the Controller of Accounts shall do the needful in accordance with law as early as possible. 5.

The writ petition is disposed of.

Urgent certified copy of this order be granted on proper application.
