This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Special Case No.218 of 2021, pending in the file of learned Sessions Judge-cum-Special Judge, Balasore, arising out of Jaleswar P.S. Case No.279 of 2021, offence under Sections 21(c)/29 of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Balasore by order dated 05.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner on instructions submits that the basis of implication of the petitioner in the case at hand is on account of co-accused statement.

This Court perused the order of rejection which clearly states that the petitioner is categorically involved in 5 other cases of similar nature.

Taking into account the criminal proclivity of the petitioner, this Court is not inclined to entertain this bail application, wherein the contraband (Brown Sugar) seized is to the tune of 584 gms, more than commercial quantity. 8.
Accordingly the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
